Welcome to the ARTIST par Marilyn website, operated by L’ABC du Maquillage Inc. (“we”, “us”, “our”). By visiting our website or making a purchase, you are using our services (the “Services”) and agree to be bound by these Terms of Use, as well as our Privacy Policy.

1. Access and Account

Any indicated shipping and delivery times are provided for information purposes only. We are not responsible for delays caused by carriers, customs, weather conditions or any event beyond our reasonable control.
The risk of loss or damage is transferred to the carrier at the time the parcel is handed over to them. From that point on, the risk transfers to you, and you must contact the carrier directly in the event of any transport-related issue.

All content within the Services (texts, images, videos, logos, trademarks, graphics, layouts, etc.) is the property of L’ABC du Maquillage Inc. or its partners and is protected by applicable intellectual property laws.

Our online store is powered by Shopify. However, sales made on our website are concluded directly between you and L’ABC du Maquillage Inc. / ARTIST par Marilyn.
By using our Services, you acknowledge that Shopify is not responsible for transactions, products, services, deliveries or disputes between you and us. You release Shopify from any liability related to your purchases on our website.

22. Mobile Messaging Service (SMS)
We offer a mobile messaging (SMS) service that allows us, at your request, to send order updates, account alerts, shipping notifications, as well as promotional messages (offers, reminders, new products, etc.). By subscribing to this service, you agree to the terms below, which form an integral part of these Terms of Use.
22.1 Nature of the Service
By subscribing, you agree to receive recurring SMS messages from ARTIST par Marilyn / L’ABC du Maquillage Inc. at the mobile phone number you provided. Messages may be sent using an automatic telephone dialing system or similar technology.
22.2 Consent
Your subscription to the service is voluntary. Your consent to receive SMS messages is never a condition of purchase. You can make purchases without subscribing to the mobile service.
22.3 Fees and Responsibility of the Subscriber
We do not charge for sending SMS messages. However, your mobile carrier may apply messaging and data fees. You are solely responsible for all fees associated with your mobile plan. The frequency of messages may vary.
22.4 Unsubscribing
You may unsubscribe from the SMS service at any time by replying “STOP” to a received message, or by following the unsubscribe instructions included in our messages (when a link is available). You will then receive a message confirming your unsubscription.
If you are subscribed to multiple messaging programs from ARTIST par Marilyn, you must unsubscribe from each program separately, unless otherwise indicated.
22.5 Help and Support
For help regarding the SMS service, you can reply “AIDE” or “HELP” to a received message, or write to us at: info@artistparmarilyn.com.
22.6 Accuracy of Number and Changes
You agree to provide a valid mobile phone number. If you change your number, you will need to subscribe to the service again with your new number. Mobile carriers are not responsible for delayed or undelivered messages.
22.7 Limitation of Liability for the SMS Service
To the extent permitted by applicable law, we are not responsible for failures, delays or delivery errors related to the SMS service, nor for any actions you may or may not take in reliance on the information provided through this service.
22.8 Privacy and SMS
We respect your right to privacy. Your personal information used in connection with the SMS service is processed in accordance with our Privacy Policy. To operate this service, certain data may be processed by our technology partners (for example, Klaviyo).
23. Changes to the Terms of Use
We reserve the right to modify these Terms of Use at any time. The most recent version will always be available on this page. The date of the latest update will be indicated at the top of the document.
Your continued use of the Services after any changes are posted constitutes your acceptance of those changes. If a change is material, we may notify you by email or by posting a notice on the website, in accordance with applicable laws.
